In addition, when you use any CityMint service, you will be subject o the rules, guideline, policies, terms and conditions applicable to that service and you will be subject to all governing state and federal laws.
User Agreement
By visiting, using or registering for the Website or any Service, you agree to be bound by the terms and conditions of this Terms of Service, including any changes which CityMint may determine to make to this Terms of Service from time to time. Additionally, if you register for or use a specific Service, you also agree to be bound by any specific terms and conditions or rules ("Rules") applicable for such Service as provided directly to you or posted on the Website. If you do not agree with this Terms of Service, the Privacy Policy and any applicable Rules, you may not register with, access or use the Website or the Service. By using the Website or the Service and/or by providing any information to CityMint, you warrant and represent that (i) you have read, understood and agree to be bound by this Terms of Service; (ii) you are at least 18 years of age, or you are older than 13 but not yet 18 years of age and have parental permission to use the Website and Service; (iii) you are the owner of the Device whose phone number you are entering, or if you do not own the Device, you have explicit permission from the owner of the Device to use the Device, enter the phone number for such Device (iv) you are a resident of the U.S.
Use of Service
By accessing this Web site you are agreeing to all of the terms, conditions, and statements included in this legal statement. The entirety of this site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose that is not expressly permitted by CiytMint. The CityMint site may not be linked to any other site without prior consent of CityMint. CityMint and its affiliates reserve the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if CityMint believes that customer conduct violates applicable law, disrupts our normal business activities or is harmful to the interests of CityMint and its affiliates.
In order to use the Services, you must provide CityMint your Device phone number (the "Device Data"). You agree to provide current, complete and accurate Device Data and you agree to update your Device Data and other account information as necessary to keep it current, complete and accurate. CityMint will use your Device Data and other account information in accordance with its Privacy Policy. CityMint shall have no liability associated with or arising from your failure to maintain current Device Data, including, but not limited to, your failure to receive critical information. You are responsible for all activities conducted under your account, whether or not you authorized such activity.
Changes to this Terms of Service
CityMint reserves the right at any time and from time to time to amend, supplement or modify the terms of this Terms of Service. We will post or display notices of material changes on the Website and those changes will become effective ten (10) days after the date of posting. Your continued use of the Website and/or Service after the changes become effective, signifies your agreement to bound by such modified Terms of Service.
Changes
When you register for CityMint services, third party charges such as from your Carrier, standard text rates may apply when you register for and/or use a Service. Please review your agreement with your Carrier or contact your Carrier for more details.
Terms of Purchase
The final charges for your order may be different than those stated on the website. CityMint does not assume any responsibility or liability for the actions, products, and content of any third parties related to the creation or delivery of your order. You agree to pay all fees and charges incurred in connection with your purchases (including any applicable taxes) at the rates in effect when the charges were incurred. We may require additional verifications or information before accepting any order.
Credit Card Payment Service
CityMint uses credit card as a method of payment, you agree that you must be authorized to use the credit card presented as a method of payment. Prior to the purchase of any goods or services on our website, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. If CityMint does not receive payment from your credit card issuer or its agent, you agree to pay all amounts due upon demand by CityMint or its agents. The final charges on your credit card may be different than those stated on the website.
Credit Card Payment Service
If you are not satisfied with your order, please contact CityMint Customer Service immediately via email at support@citymint.com and include the order number and restaurant name. All sales are final unless order problems/issues are confirmed with our restaurant partners or otherwise determined by CityMint, at its sole discretion, to be actionable. In such cases, CityMint will issue credit for use on future orders through the CityMint website. All order problem/issue inquiries must be received within 24 hours of the order date listed on your order confirmation email. No cash refunds will be issued by CityMint.

By registering or placing an order with us, you are consenting to receive e-mails from us regarding your registration or your order. Additionally, we may share your e-mail address with the local restaurant(s) from which you order.
Reviews and Comments
If at any time, CityMint enables site visitors to post reviews of and comments on products featured on the site, the party posting that comment or review grants CityMint and its affiliates a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such reviews and comments throughout the world in any media. You also grant CityMint and its affiliates the right to use the name that you submit with any review or comment, if any, in connection with such review or comment.
Risk of Loss
All items purchased through CityMint are made pursuant to a delivery contract. Should there be delivery errors; CityMint will offer reasonable assistance in the correction of that error. However, the risk of loss and title for such items pass to you upon our delivery to the carrier. You must file any such claims with that delivery carrier.
Indemnity
You agree to defend, indemnify and hold harmless CityMint and its affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of your use of the site.
Disclaimer
